| Resumen en inglés | The aim of this paper is to analyse wills as a right to inheritance. The present work is based on a descriptive and comparative analysis of 12 relevant scientific articles in the field of inheritance law. The analysis of the will as a right to inheritance reveals the profound interrelation between individual autonomy and the legal regulations governing the transmission of assets post mortem. The will, beyond being a simple legal instrument, is configured as a manifestation of the personal will that must balance respect for the freedom of the testator with the demands of equity and protection of the rights of the heirs. |
| Resumen en español | Se tiene por objetivo analizar el testamento como derecho a la sucesión hereditaria. El presente trabajo se desarrolla a partir de un análisis descriptivo y comparativo de 12 de artículos científicos relevantes en el campo del derecho sucesorio. El análisis del testamento como derecho a la sucesión hereditaria revela la profunda interrelación entre la autonomía individual y las normativas legales que regulan la transmisión de bienes post mortem. El testamento, más allá de ser un simple instrumento jurídico, se configura como una manifestación de la voluntad personal que debe equilibrar el respeto por la libertad del testador con las exigencias de equidad y protección de los derechos de los herederos. |
