| Resumen en español | Este artículo tiene por objeto ofrecer nuestra interpretación de D. 16,3,13,1 (Paul. 31 ad ed.), a partir de una exégesis detallada del fragmento. En concreto, se busca demostrar que la dolosa falta de restitución de la res deposita por parte del depositario (non reddere) a que se alude en la fuente, no constituye un supuesto de furtum y, por consiguiente, la condictio que Paulo concede al depositante no corresponde a la así llamada condictio ex causa furtiva, sino más bien a una hipótesis de condictio sine datione no furtiva. Por tanto, la fuente analizada se inserta en el original pensamiento del jurista tardo-clásico sobre la relación del deponere con la condictio y el credere edictal |
| Resumen en inglés | The purpose of this article is to offer our interpretation of D. 16,3,13,1 (Paul. 31 ad ed.), based on a detailed exegesis of the fragment. Specifically, it seeks to demonstrate that the willful lack of restitution of the res deposita by the depositary (non reddere) alluded at the source, does not constitute an instance of furtum and, therefore, the condictio that Paulus grants to the depositor it does not correspond to the so-called condictio ex causa furtiva, but rather to a hypothesis of non-furtive condictio sine datione. Therefore, the analyzed source is inserted in the original thought of the late-classical jurist on the relationship between deponere, condictio and the edictal credere |
