| Resumen en español | La presente investigación tuvo por objetivo analizar la relación entre la creatividad computacional y la protección autoral de las obras generadas por sistemas de inteligencia artificial. Se concluye que el sistema actual se basa en preceptos que no favorecen las nuevas formas de creatividad artificial. Cada vez son más las expresiones artísticas generadas por computadora que satisfacen el criterio de originalidad objetiva y poseen la altura creativa suficiente para alcanzar protección autoral. Se recomienda realizar una reforma legislativa que brinde mecanismos adecuados de protección para las obras generadas por los sistemas de inteligencia artificial con el propósito de dar respuesta a las necesidades actuales y estimular la creatividad, promover la innovación y brindar un mayor bienestar y progreso social |
| Resumen en inglés | The purpose of the research was to analyze the relationship between computational creativity and the copyright protection of works generated by artificial intelligence systems. It is concluded that the current system is based on precepts that do not favor new forms of artificial creativity. More and more computer-generated artistic expressions meet the criterion of objective originality and possess sufficient creative height to achieve authorial protection. It is recommended to carry out a legislative reform that provides adequate protection mechanisms for works generated by artificial intelligence systems with the purpose of responding to current needs and stimulating creativity, promoting innovation and providing greater well-being and social progress |
