| Resumen en español | El artículo estudia algunos avatares de la organización y el funcionamiento de la justicia federal en la "Confederación" (1854-1861). El análisis contempla problemas que han sido soslayados por los estudios existentes. El enfoque escogido vincula la problemática con las redefiniciones del rol y de los vínculos político-institucionales de los poderes provinciales y el nacional y relaciona al poder judicial con los otros dos poderes estatales. En primer lugar se analiza la ley que, al disponer los requisitos de habilitación de los "abogados nacionales", permitió la conformación de la justicia federal. Luego, se examina su dinámica desde el accionar de las provincias y de la Cámara Superior de Justicia (que suplió a la Corte Suprema de Justicia). Finalmente, se realizan algunas consideraciones finales en las que se proyecta la experiencia hacia el período abierto en 1862. |
| Resumen en inglés | The article studies some vicissitudes in the organization and functioning of the federal justice in the "Confederación" (1854-1861). We take into consideration problems that had not been considered in other studies. The problematic is linked with the redefinitions of the role and the political - institutional relations between the provincial powers and the central one and between the judicial power and the other two states powers. First we analyze the law that, on having arranged the requirements of the "national lawyers", allowed the conformation of the federal justice. Then, we examine its dynamics considering the action of the provinces and of the "Cámara Superior de Justicia" (that replaced the Supreme Court of Justice). Finally, in our conclusions we project the experience to the period opened in 1862. |
