| Resumen en español | El presente artículo realiza un análisis en torno al delito político como un tema clásico en el ámbito del derecho penal. El artículo está estructurado principalmente en dos aspectos. Por una parte, se realiza una reflexión sobre los aspectos teóricos generales del delito político, de otra parte se hace una revisión comparativa de los delitos políticos en los ordenamientos jurídicos vigentes de Colombia y Alemania. En este sentido, el trabajo se divide en tres secciones. En primer lugar, se plantea una breve reseña histórica sobre la genésis del delito político. La segunda parte se ocupa de precisar conceptos generales y esbozar las diferentes teorías sobre el delito político, especialmente ahondando en la teoría del delincuente por convicción. Por último, se realiza un cotejo normativo de los delitos políticos en el código penal colombiano y en el StGB alemán. En términos generales, el presente artículo es un estudio general sobre aspectos históricos y fundamentos conceptuales del delito político, dirigido a fijar las bases para un estudio más profundo en el caso colombiano por parte del autor |
| Resumen en inglés | In this article you will find a study about political crime as a classic in the field of criminal law. The article is structured mainly in two aspects. On the hand you will find a reflection on the general theoretical aspects of political crimes. On the other hand, there is a review of comparative political crimes in the legal system of both Colombia and Germany. In this respect, the article is divided into three sections. First, it presents a brief history on the genesis of political crime. The second part deals with general concepts to clarify and outline the various theories of political crime, especially the theory of politically motivated criminal. Finally, a normative comparison is made between political crimes in the Colombian penal code and the German StGB. This article is a general review of historical and conceptual basis of political crime, aimed at laying the foundations for further study in the Colombian case |
| Otro resumen | Bei dieser Arbeit handelt es sich um eine Auseinandersetzung mit den politischen Delikten, als ein klassisches Thema im Bereich des Strafrechts. Dieses Thema wird hier insbesondere in zwei Aspekten betrachtet, zum einen findet eine Überlegung über allgemeine Bezüge zu den politischen Delikten statt und zum anderen wird ein Vergleich zwischen den aktuellen Straftaten in Deutschland und Kolumbien gemacht. Dafür umfasst die Arbeit drei Abschnitte. Zuerst wird ein kurzer historischer Überblick zu den politischen Delikten gemacht. Der zweite Teil beschäftigt sich mit allgemeinen Begriffen und Theorien über das politische Delikt, im Besonderen aber mit der Lehre des Überzeugungstäters. Am Ende werden die Normen über die politischen Delikte in dem kolumbianischen und deutschen StGB verglichen. Im Allgemeinen ist diese Arbeit eine Studie über die historischen und begrifflichen Grundlagen des politischen Delikts, im Sinne einer zukünftigen Vertiefung in das kolumbianische Thema des politischen Delikts |
