| Resumen en inglés | The vindication and the application of mutual benefits, such as the payment of expenses or useful improvements to the possessor in good faith, are issues of interest within the constitutional State of rights and justice. Hence, the objective was to analyze the action of vindication in relation to the sense of equity and justice in the administration of justice within the Ecuadorian context. The study was developed addressing theoretical aspects, with a qualitative approach research, dogmatic type and analytical method; for which documentary information of statements of several authors on the subject was reviewed, as well as the jurisprudence of the National Court of Justice of Ecuador was studied. It is concluded that the sense of justice and equity when claiming a property has to do with the fact of returning to the one who has exercised possession in good faith in the property, all the expenses or improvements made in it. |
| Resumen en español | La reivindicación y la aplicación de las prestaciones mutuas, tales como el abono de expensas o de mejoras útiles al poseedor de buena fe, son temas de interés dentro del Estado constitucional de derechos y justicia. De allí que, el objetivo fue analizar la acción de reivindicación con relación al sentido de equidad y justicia en la administración de justicia dentro del contexto ecuatoriano. El estudio se desarrolló abordando aspectos teóricos, con una investigación de enfoque cualitativo, tipo dogmática y método analítico; para lo cual se revisó información documental de enunciados de varios autores sobre la materia, así como se estudió la jurisprudencia de la Corte Nacional de Justicia del Ecuador. Se concluye que el sentido de justicia y equidad al reivindicar un inmueble tienen que ver con el hecho de devolver a quien ha ejercido posesión de buena fe en el inmueble, todas las expensas o mejoras realizadas en el mismo. |
