| Resumen en inglés | The purpose of this article is to address the commercial trust contract and the applicable legal regime, which is developed between legal institutions of public and private law. The foregoing taking into account that in the exercise and development of the public function, state entities are forced to have a private collaborator (trust company) that allows them through the fiduciary contract to be able to fulfill and carry out legal instruments, financial and technical that allow them to meet state needs. The methodology used, on the one hand, is of an inductive type, since it starts from the particular, such as the trust contract, in order to establish the general bases of said contract when it involves public resources, and on the other hand, of an analytical type, since which breaks down the parts, elements, particularities and characteristics of said contract. The investigative text is developed within the framework of the following research lines of the Universidad Libre de Colombia: (i) Law, State, culture and society, (ii) Social and economic development; and (iii) Sustainable development, technology and innovation. |
| Resumen en español | En este artículo se aborda el contrato de fiducia mercantil y el régimen jurídico que le aplica, el cual se desarrolla entre instituciones jurídicas propias del derecho público y privado. Lo anterior teniendo en cuenta que en el ejercicio y en el desarrollo de la función pública las entidades estatales se ven abocadas a contar con un colaborador privado (sociedad fiduciaria), que a través del contrato fiduciario les permita cumplir y llevar a cabo instrumentos jurídicos, financieros y técnicos para atender las necesidades estatales. La metodología empleada es de tipo inductivo, jurídico y analítico. El texto investigativo se desarrolla en el marco de las siguientes líneas de investigación de la Universidad Libre de Colombia: i) Derecho, Estado, cultura y sociedad, ii) Desarrollo social y económico y iii) Desarrollo sostenible, tecnología e innovación. |
