| Resumen en inglés | On November 24, 2010, the Inter-American Court of Human Rights determined the Brazilian State's international responsibility for the enforced disappearance of Guerrilha do Araguaiamilitants during the military dictatorship. Therefore, given that Brazil was condemned for the violation of several human rights ensured by the American Convention on Human Rights, reparations were imposed, including the obligation to investigate the facts. In this scenario, the present work aims to describe the measures taken by the Brazilian State in fulfilling the obligation to investigate the facts in the Gomes Lund and others case, in order to observe how, and to what extent, the Guerrilha do Araguaiavictims right to access justice has being assured. To this end, will be described the actions of the Transition Justice Working Group created within the scope of the Federal Public Prosecutors Office. |
| Resumen en portugués | Em 24 de novembro de 2010, a Corte Interamericana de Direitos Humanos determinou a responsabilidade internacional do Estado brasileiro pelo desaparecimento forçado de militantes da Guerrilha do Araguaia durante a ditadura militar. Por conseguinte, tendo em vista que o Brasil foi condenado pela violação de diversos direitos humanos assegurados pela Convenção Americana de Direitos Humanos, foram impostas reparações, dentre estas o dever de investigar os fatos. Nesse cenário, o presente trabalho visa descrever as medidas tomadas pelo Estado brasileiro no cumprimento do dever de investigar os fatos no caso Gomes Lund e outros, a fim de se observar como, e em que medida, tem sido assegurado o direito de acesso justiça das vítimas da Guerrilha do Araguaia. Para tal, será descrita a atuação do Grupo de Trabalho Justiça de Transição criado no âmbito do Ministério Público Federal. |
