| Resumen en español | Teniendo al Estado de Nayarit como sujeto con el carácter de representado cabe preguntarse ¿A qué órgano le corresponde actuar en nombre del Estado de Nayarit?, la representación constitucional del Estado implica actuar en nombre de Nayarit, por lo que según nuestra opinión la fracción XXII del artículo 47 de nuestra Carta Magna Local, otorga la representación constitucional originaria del Estado a la Asamblea Legislativa, ello así, en razón de que dicho órgano deliberativo posee facultades para delegar tal representación en la persona del gobernador, para que por sí o por apoderado especial, actúen con la representación estatal, en la medida y con las restricciones que aquella considere en los casos que corresponda; conservándola de forma permanente, consecuentemente es válido afirmar que la representación constitucional del Estado recae en el Poder Legislativo y no en el gobernador |
| Resumen en inglés | Considering the state of Nayarit as the subject or character represented, the following question arises. What Legislative body is responsible for acting on behalf of the State of Nayarit? The constitutional State representation involves acting on Behalf of Nayarit, So in our opinion the fraction XXII from the rule 47 of our Local Magna Carta, grants the original constitutional representation of the State to the Legislative house, it so , on the ground that the deliberative body has powers to delegate such representation in the person of the governor, so for its own or thru its special attorney acting with the State representation and as far as the constraints considered in appropriate cases keeping it permanently it is valid to state that constitutional representation it vested in the Legislature not in the Governor |
