| Resumen en español | El presente artículo desarrolla el contenido del derecho al debido proceso, el cual, si bien ha alcanzado un importante desarrollo, sigue siendo objeto de múltiples confusiones en cuanto a su alcance y a su contenido real. Para llevar a cabo tal análisis se realiza una revisión de distintos tratados internacionales que reconocen este derecho, así como la propia Constitución de México, trabajo que permite apreciar con mucha mayor claridad la amplitud de su contenido, pero también sus divergencias, las que hacen más complejo su entendimiento. Por ello, y retomando el contenido de la jurisprudencia emitida por la Primera Sala de la Suprema Corte de Justicia de la Nación, como un ejemplo de máxima claridad, se expone el contenido esencial del derecho al debido proceso, de tal manera que esto haga posible su entendimiento y con ello evitar incurrir en una serie de errores y sesgos al momento de tratar de explicarlo y defenderlo |
| Resumen en inglés | This article develops the content of the right to due process, even though it has reached an important development, it continues to be the subject of multiple confusions regarding its scope and its real content. To carry out such an analysis, a review of different international treaties that recognize this right is carried out, as well as the Constitution of Mexico itself, a work that allows us to appreciate with much greater clarity the breadth of its content, but also its divergences, which make it more difficult to understand. Therefore, and returning to the content of the jurisprudence issued by the First Chamber of the Supreme Court of Justice of the Nation, as an example of maximum clarity, it is exposed what is the essential content of the right to due process, in such a way that this make its understanding possible and thereby avoid incurring a series of errors and biases when trying to explain and defend it |
