| Resumen en español | Desde fines de 2009 la Corte Suprema ha promovido la idea del “decaimiento del procedimiento administrativo sancionador” como un medio tendiente a limitar la potestad sancionadora de la administración. En pocas palabras, esta idea consiste en que si una resolución condenatoria tarda demasiado tiempo en ser adoptada, no tiene valor jurídico. La noción fue rápidamente difundida en el medio legal, dando origen a una jurisprudencia frondosa. Este artículo, sin embargo, cuestiona los fundamentos jurídicos de esta doctrina y postula que los remedios que el derecho arbitre para enfrentar la morosidad administrativa no pueden concebirse sin atender al interés general que justifica la potestad sancionadora de la administración |
| Resumen en inglés | Since the end of 2009, the Supreme Court has promoted the idea of a "decline in the administrative inquest procedure" as a means to limit the sanctioning authority of the Administration. Briefly explained, if a decision on a sanction takes too long to be adopted, it is of no legal value. The idea spread quickly in the legal environment, giving rise to abundant jurisprudence. However, this article questions the legal basis for this doctrine and postulates that the remedies afforded by law to confront tardy administrative action cannot be conceived without regard to the general interest justifying the sanctioning authority of the Administration |
