| Resumen en inglés | The article questions, based on information from the 2016 School Census of Basic Education, whether and how educational management has materialized the right to education enshrined in the 1988 Federal Constitution. It is assumed that proclaiming rights is distinct from guaranteeing its effectiveness. The study composes a research that investigates perspectives and nuances of the guarantee of the right to education, with emphasis on basic education. The text recovers the trajectory of the vicissitude of the right to education in the Brazilian constitutions and analyzes recent data referring to school attendance in early childhood, elementary education and secondary education in the country. It concludes that, although we have advanced in some aspects of the realization of the right to education, we still have a long way to go for the sake of full compliance with the provisions of the Charter of 1988, especially regarding access to early childhood and secondary education, and permanence and success in elementary school |
| Resumen en portugués | O artigo problematiza, a partir de informações do Censo Escolar da Educação Básica de 2016, se e como a gestão educacional tem materializado o direito à educação consagrado na Constituição Federal de 1988. Parte-se do princípio de que proclamar direitos é distinto de efetivá-los. O estudo compõe pesquisa que investiga perspectivas e nuances da garantia do direito à educação, com ênfase na educação básica. O texto recupera a trajetória da vicissitude do direito à educação nas constituições brasileiras e analisa dados recentes referentes ao atendimento escolar na educação infantil, no ensino fundamental e no ensino médio no país. Conclui que, embora tenhamos avançado em alguns aspectos da efetivação do direito à educação, ainda temos um longo caminho a ser trilhado para o cumprimento integral do disposto na Carta Magna de 1988, especialmente em relação ao acesso à educação infantil e ao ensino médio e à permanência e sucesso escolar no ensino fundamental |
