| Resumen en inglés | The concept of "double jeopardy" is a fundamental pillar for the guarantee of justice and the protection of the fundamental rights of individuals. The objective of this article is to analyse the application of the principle of double jeopardy in the Ecuadorian criminal procedure system, in order to understand its importance and how it is applied in practice. The study of this issue is fundamental to guarantee a fair due process and that the fundamental rights of the accused are respected. The research focused on a descriptive documentary study with a bibliographic design. The right to double jeopardy took the Ecuadorian criminal justice system by surprise, a guarantee that ensures the protection of the fundamental rights of the accused. Its constitutional recognition and the adoption of the American Convention on Human Rights have consolidated its importance in the development of fair and impartial criminal proceedings. |
| Resumen en español | El concepto de "El Doble conforme" se constituye como un pilar fundamental para la garantía de justicia y la protección de los derechos fundamentales de los individuos. Se concibe como objetivo de este artículo analizar la aplicación del principio de doble conforme en el sistema procesal penal ecuatoriano, con el fin de comprender su importancia y cómo se aplica en la práctica. El estudio de este tema es fundamental para garantizar un debido proceso justo y que se respeten los derechos fundamentales de los imputados. La investigación se centró en un estudio descriptivo documental con un diseño bibliográfico. El derecho al doble conforme tomo por sorpresa al sistema penal ecuatoriano esta garantía que asegura la protección de los derechos fundamentales del procesado. Su reconocimiento constitucional y la adopción de la Convención Americana sobre Derechos Humanos han permitido que se consolide su importancia en el desarrollo de procesos penales justos e imparciales. |
