| Resumen en español | Se realiza un breve recorrido por los conceptos de “Ley”, “violencia”, “culpa”, “sujeto” y “estado de excepción” (Agamben) destacando las relaciones entre ellos y con los conceptos psicoanalíticos de superyó y pulsión. La hipótesis del artículo es que el amparo que ofrece la cultura impone al sujeto, a la vez, el pago de un tributo de infelicidad y sometimiento que resulta estructural. La agresión interiorizada como consecuencia de la ley de la cultura se hace sanción interior y co-manda coaccionando contra la propia subjetividad. El superyó resulta el pago ineludible a la cultura. Sinuosidades de la ley de la cultura que inscribe la culpabilidad: como lazo social y como límite de ese lazo. La “predecibilidad” del mundo que pretende el Derecho se topa con las mociones pulsionales que alientan en todos los humanos. Ello así porque aunque la ley los pacifica no deja de provocarles la inquietante fascinación por abismarse más allá de ese límite. Por último, se analiza la relación de la ley y la fuerza-de-ley con la culpa y la pulsión anómica para arribar a las hipótesis sobre el castigo – como respuesta del superyó por vía de la culpa – en las sociedades violentas y fragmentadas |
| Resumen en inglés | We performed a brief review of the concepts of “Law”, “violence”, “fault”, “subject” and “state of exception” (Agamben) highlighting the relationship between them and the psychoanalytic concepts of superego and Trieb. The hypothesis of the article is that the protections offered by the culture dictates the subject, while the payment of a charge of misery and subjugation that is structural. The internalized aggression following the law of culture is internal sanction and co-ordain sends his own subjectivity. The superego is the inevitable payment to culture. Intricacies of the law of the culture that forms the guilt as social bond and how that bond limit. The “predictability” of the world that claims the law is met with the instinctual impulses that encourage in all humans. This is so because although the law does not stop the peaceful cause disturbing fascination lose herself beyond that limit. Finally, we analyze the relationship of law and strength-of-law with guilt and anomic drive to arrive at assumptions about the punishment of the superego – like response by way of guilt – in violent and fragmented societies |
