| Resumen en español | El tema de la figura de la compensación alimenticia se encuentra en su pleno auge, empero, a pesar de que, dicho derecho se encuentra plenamente reconocido en el Estado Mexicano, éste cuenta con diversas lagunas; motivo por el cual, tanto la Primera Sala, de la Suprema Corte de Justicia de la Nación, como los Tribunales pertenecientes al Poder Judicial de la Federación, se han dado a la tarea de ir acotando el vacío existente. El objeto de este artículo es en primer lugar, conceptualizar la figura de la compensación alimenticia y, las vertientes que emergen de ésta, - vertiente resarcitoria y asistencial -, así como la diferencia entre éstas; además de conocer el marco jurídico, y el principio en el cual, se basa para su eclosión |
| Resumen en inglés | The issue of the fi gure of ali-mony oblige, in its compensation and assistance side, is in full swing, despite the fact that this right is fully recognized in the Mexican State, it has various gaps; which is why both the Supreme Court of Justice of the Nation, as well the the District Courts, the Collegiate Circuit Courts and the Unitary Circuit Courts, have taken on the task of narrowing the existing gap.
