| Resumen en inglés | Our current society has reached alarming parameters of violence, crime has progressively permeated in society, a situation that has become a great challenge for the State and its government apparatus. Due to this conjunctural context in 2008 a change in the way of conceiving criminal procedural law materialized in Mexico, the Mexican Constitution was amended in multiple numerals to erect a model of an accusatory court, thereby abandoning the once traditional inquisitive system; The ontological reason for this new procedural machinery sought to streamline the criminal process, making its operations more efficient and making it more secure, therefore, to help with this purpose, the Magna Carta also incorporated Alternative Justice and its dispute resolution mechanisms, figures that do succeed in establish themselves with operational autonomy and with a solid organic structure, will give way to the genuine implementation of the restorative penal model in Mexico as an emerging paradigm |
| Otro resumen | Nuestra sociedad actual ha alcanzado parámetros de violencia alarmantes, la criminalidad ha permeado progresivamente en la sociedad, situación que se ha tornado en un gran reto para el Estado y su aparato de gobierno. Debido a este contexto coyuntural en el año 2008 se materializó en México un cambio en la forma de concebir el derecho procesal penal, la Constitución Mexicana fue reformada en múltiples numerales para erigir un modelo de corte acusatorio, abandonando con ello el otrora sistema tradicional inquisitivo; la razón ontológica de esta nueva maquinaria procesal buscaba dinamizar el proceso penal, eficientando sus operaciones y tornándolo más garantista, por ello para coadyuvar con este propósito la carta Magna incorporó aparejadamente a la Justicia Alternativa y sus mecanismos de resolución de controversias, figuras que si logran afianzarse con autonomía operativa y con una estructura orgánica sólida, darán paso a la implementación genuina del modelo restaurativo penal en México como paradigma emergente |
