| Resumen en español | El objetivo del trabajo es presentar el entramado normativo referente a los menores en contexto de migración y de tránsito por México. Esto con el fin de conocer las normas en los diferentes planos de la legislación mexicana, siguiendo su orden jerárquico: Constitución Política, Ley de Migración, Reglamento sobre la materia, y las legislaciones sobre la niñez en nuestro país. Un segundo objetivo es conocer el debate que muchos de esos dispositivos generan al observarse distintas situaciones que, en algunos casos, incluyen contradicciones, el empalme de instrumentos nacionales o ambigüedad en su interpretación y, por tanto, en su aplicación efectiva. Se retoman algunos temas específicos, como la detención de niñas, niños y adolescentes (NNA); el interés superior del niño; las autoridades involucradas y el acompañamiento de los menores. Finalmente, quedan algunas propuestas que buscan aportar a la reflexión y, eventualmente, a la mejoría de la normatividad |
| Resumen en inglés | The present study presents the regulatory framework for minors living in a context of migratory transit through Mexico in order to ascertain the regulations in the various levels of Mexican legislation, in accordance with their hierarchical order: the Political Constitution; the Migration Law; the corresponding regulations; and, our nation’s legislation on childhood. A second objective is to examine the debate generated by these legal devices in different situations that, in some cases, involve contradictions, the alignment of national instruments, or ambiguity in their interpretation, and, therefore, their effective application. Other subjects are also reviewed, such as the detention of girls, boys, and adolescents (NNA), the best interests of the child, the corresponding authorities, and the accompaniment of minors. Finally, the present paper deals with some proposals contributing to reflection on and, eventually, the improvement of the regulations |
