| Resumen en español | El fenómeno de la globalización trae consigo toda una revolución en el ámbito jurídico, que conllevará a nuevas demandas y a la creación de nuevas instituciones donde aquéllas puedan solucionarse. El pensamiento lineal, secuencial, cartesiano, que tradicionalmente se ha usado para enfocar los problemas científicos, políticos y jurídicos ya no sirve para describirlos, analizarlos, ni mucho menos para actuar sobre el derecho. Por ello el autor ha adoptado, hace ya años, un enfoque sistémico y cibernético de los fenómenos jurídicos. Él observa que, profundizando en el tema de la globalización jurídica, se puede ver que hay múltiples y diversas globalizaciones jurídicas, y también, ya al llegar al final de la investigación, ha advertido la profunda incidencia que esta situación tiene con respecto a la teoría del derecho. Estos aspectos e incidencias se desarrollan en este trabajo, siendo su conclusión que hay que repensar el derecho y la teoría que lo estudia |
| Resumen en inglés | The phenomenon of the globalization brings with him a whole revolution in the legal scope which will entail to new demands and to the creation of new institutions where those can be solved. The linear, sequential, cartesian thought, which has been traditionally used to approach the scientific, political and legal problems, is not good anymore to describe or analyze them, and much less to influence the law. For that reason the author has adopted, for quite some years, a systemic and cybernetic approach to the legal phenomena. He observes that by studying in depth the subject of the legal globalization, it is possible to see that there are multiple and diverse legal globalizations, and he has also noticed, at the end of his investigation, the deep incidence that this situation has in regard to the theory of law. These aspects and incidences are developed in this work, whose conclusion is that it is necessary to rethink the law and the theory that studies it |
