| Resumen en inglés | The present work aims to analyze the impacts of a large-scale infrastructure project on the operational territory, using the deductive qualitative method with documentary research from national and international legal bibliographies. It aims to analyze the impacts of a large-scale infrastructure project in its area of operation, focusing on the emblematic case study of the Xingu Nightclub. Through this analysis, the study aims to understand different perspectives and arguments regarding the accountability of the companies involved in the construction of the Belo Monte Hydroelectric Plant (UHE) for the increase in the sexual exploitation of adolescents in the region. Based on this case analysis, the study intends to address the limits of the concept of "causal nexus," considering how it has traditionally been applied jurisprudentially by courts and other mechanisms in the context of civil liability for damages. This will be analyzed considering the expectations established by the Guiding Principles on Business and Human Rights, which call for companies to respect human rights. |
| Resumen en portugués | O presente trabalho tem por objetivo, a partir de um caso que se pode considerar emblemático acerca dos impactos de um empreendimento de larga escala sobre o território da operação, o caso da Boate Xingu, compreender as diferentes perspectivas, assim como os diferentes argumentos, acerca da responsabilização das empresas envolvidas com a construção da UHE de Belo Monte, no aumento da exploração sexual de adolescentes na região. Com base na análise desse caso, pretende-se tratar de limites acerca do conceito de "nexo de causalidade", considerando a forma como este vem tradicionalmente sendo usado jurisprudencialmente pelos Tribunais e por outros meios no âmbito da responsabilidade por danos civis, considerando-se a expectativa criada pelos POs ao estabelecer a responsabilidade de respeitar os Direitos Humanos das empresas. |
