| Resumen en inglés | After creasing the main lines of differentiation between the objective rights, predominant in the Medieval era and subjective rights, the formal genesis of human rights, the article characterizes the Franciscan genesis of subjective rights (mainly advocated by Michel Villey and John Milbank) that is not free from influences in the construction of liberal politics and economics: the Franciscan voluntarism (primacy of divine will over divine reason with consequences on conversion of the Decalogue of natural law in divine positive law, opening doors to the individual's free will and sovereign´s free and absolute will), the Franciscan nominalism (opening the tendency to only consider individuals as provided of reality before the absolute sovereign, endangering all intermediate intuitions and all the reciprocity character of objective rights), the Franciscan separation between property and use (giving the order that the right to use without property, enables another order of men the right to property without use, stockpiling). The article tries to argue that both the authors of the Peninsular School of Peace as other authors remain in its vicinity still scholastics, still moving in an eminently objective table that time will soon overcome. The "objective evidence" are, in the School of Peace, the insistence on natural law as the foundation, the uncompromising defense of communities before a power that at time was enlarging, the relationality and the not absolutization rights, pointed to the common good continuously as purpose. Finally, it was pointed out the dangers of insistence, however the sacralization of subjective human rights fell, preventing a recovery of objective rights perhaps able to help finding ways for resolution of the current political and economic problems |
| Resumen en portugués | Depois de vincar as principais linhas de diferenciação entre os direitos objectivos, predominantes na era Medieval, e os direitos subjectivos, na génese formal dos direitos humanos, o artigo caracteriza a génese franciscana dos direitos subjectivos (defendida principalmente por Michel Villey e John Milbank) não isenta de influências na construção da política e economia liberais: o voluntarismo franciscano (primazia da vontade divina sobre a razão divina logo com consequências na conversão do decálogo de direito natural em direito divino positivo, abrindo portas à vontade livre do indivíduo e à vontade livre e absoluta do soberano), o nominalismo franciscano (abrindo a tendência para considerar apenas os indivíduos como providos de realidade ante o soberano absoluto, perigando todas as intuições intermédias e todo o carácter de reciprocidade dos direitos objectivos), a separação franciscana entre uso e propriedade (que dando à ordem o direito de uso sem propriedade, possibilita a outra ordem de homens o direito de propriedade sem uso, acumulação). O artigo tenta argumentar que tanto os autores da Escola Peninsular da Paz como outros autores nas suas proximidades permanecem escolásticos, movendo-se ainda num quadro eminentemente objectivo que o tempo não tardará a ultrapassar. As “provas objectivas” são, na Escola da Paz, a insistência no direito natural como fundamento, a defesa intransigente das comunidades face a um poder que já na altura se está a absolutizar, a relacionalidade e não absolutização dos direitos, o bem comum apontado continuamente como fim. Finalmente, apontam-se os perigos da insistência, entretanto caía a sacralização, dos direitos humanos subjectivos, impossibilitando uma recuperação dos direitos objectivos talvez capazes de ajudar a encontrar caminhos de resolução para os actuais problemas políticos e económicos |
