Resumen en español | El Consejo de Estado precisó los criterios para el reconocimiento del lucro cesante y del daño emergente por privación injusta de la libertad. El primero exige prueba de que al momento de la retención se ejercía una actividad lucrativa y de que no se pudo continuar desempeñándola. De probarse esta, pero no los ingresos, se presumirá que devenga el salario mínimo legal mensual vigente (SMLMV). Ahora, las prestaciones sociales solo se incrementarán en caso de que exista una relación laboral. Con relación al segundo, fijó la prueba idónea para su reconocimiento: factura o documento equivalente y certificación del pago, lo cual nos ubica en el sistema de tarifa legal de prueba |
