| Resumen en español | En primer lugar, dentro de la responsabilidad médica existe una serie de mecanismos alternos de solución de controversias, como la conciliación y el arbitraje que se prevén para la solución de conflictos cuando hay una probable responsabilidad médica, no obstante, es necesario el análisis de un nuevo método de solución de conflicto, que no solamente imponga el resarcimiento económico como reparación de este tipo, sino que, de igual manera, ayude a sanar el dolor de la víctima o paciente que sufrió de negligencia médica por alguien del personal de salud. Dado que en todo momento se auxilia al personal de salud para que colabore en el desarrollo de este proceso y pueda aceptar su responsabilidad ante tales hechos y, de igual manera, comprometerse con el paciente afectado, así como a sanar ese dolor. Es precisamente aquí donde la justicia restaurativa y sus diversas modalidades entran en la solución del conflicto para que las partes, con ayuda de un facilitador, puedan construir esa comunicación y que apacigüe el sufrimiento y el resentimiento de la víctima hacia el profesional de la salud |
