| Resumen en español | A partir del crecimiento del trabajo voluntario en la ciudad de Buenos Aires, Argentina, y considerando que no es un trabajo incluido en el Derecho del Trabajo y que tampoco existe en el país regulación legal especifica, surgen una serie de interrogantes acerca de ¿cuál es el marco legal en el que la actividad se desarrolla?, ¿ si existen posibles zonas de colisión entre trabajo voluntario y contrato de trabajo?, ¿cuál es la distinción entre uno y otro?, ¿cuál es la responsabilidad del Estado?, ¿qué otras realidades podría estar encubriendo este fenómeno?. En consecuencia el artículo pretende alertar acerca de la importancia cuantitativa del fenómeno y sus implicaciones, incentivando el debate desde el análisis del caso de España con su ley 6/1996 del 15-01-96 reguladora del “Voluntariado social”; que permite estudiar la naturaleza jurídica de la regulación estatal, su propósito, sus consecuencias y hasta ilustrar acerca de si es sano que el trabajo voluntario permanezca en dificultad para definir su grado de formalización; si es o no una técnica de huida del derecho del trabajo |
| Resumen en inglés | Since the growth of voluntary work in Buenos Aires, Argentina, and considering that this is not a type ok work included in the Work Laws and that in this country, specific legal regulation neither exists, some questions about this matter emerge: What is the legal frame within which this activity takes place? Are there any collision areas between volunteering work and employment contract?, What is the distinction between the two?, What is the responsibility of the state and what other realities could this phenomenon be concealing?. Therefore this article attempts to alert about the quantitative importance of the phenomenon and its implications, stimulating the debate from the analysis of the case in Spain with its regulating “Social Volunteer “, law 6 / 1996 of 15-01-96, which allows to study the legal nature of the state regulation, its purpose, its consequences and to illustrate whether it is healthy that volunteer work remains in difficulty to define its degree of formalization; whether or not it is a technical flight of the labor law |
