| Resumen en español | La violencia feminicida constituye un grave problema que evidencia al Estado mexicano debido a su complejidad e indiscutible necesidad de atención inmediata, a través de mecanismos ad hoc que muestren acciones efectivas en la tutela del derecho humano a una vida libre de violencia de las mujeres. Desde la perspectiva dogmático-jurídica, se estudia la violencia por razón de género contra las mujeres, haciendo énfasis en lo precisado por el Sistema Universal de Derechos Humanos y el Sistema Interamericano de Derechos Humanos como directrices de actuación del Estado mexicano. El panorama estadístico de violencia feminicida en México durante el periodo enero 2016 a abril 2020, sirve como referencia para analizar el diseño normativo del Mecanismo de Alerta de Violencia de Género contra las Mujeres, en sus vertientes de: aporía de la legitimación a la participación activa de las Organizaciones de la Sociedad Civil; y, ambivalencia de su naturaleza subsidiaria, de emergencia y sus objetivos. Introducción: La tutela efectiva del derecho a una vida libre de violencia de las mujeres representa un irreductible del Estado mexicano frente a la evolución de la violencia feminicida, en cuyo tenor, es menester considerar lo preceptuado por la Corte Interamericana de Derechos Humanos que, mediante sus resoluciones, ha establecido aspectos importantes en el abordaje de este problema. El presente artículo centra su análisis en dos rubros del diseño normativo del Mecanismo de Alerta de Violencia de Género contra las Mujeres en México: la ambivalencia en su naturaleza subsidiaria, de emergencia y sus objetivos; y, la limitación a la participación activa de las Organizaciones de la Sociedad Civil en su procedimiento, puntos de oportunidad que deben atenderse en aras de garantizarles el derecho a una vida libre de violencia. | Resumen en inglés | Femicidal violence constitutes a serious problem that the Mexican State evidences due to its complexity and indisputable need for immediate attention, through ad hoc mechanisms that show effective actions in the protection of the human right to a life free of violence against women. From a dogmatic-legal perspective, we study gender-based violence against women, emphasizing what is necessary by the Universal Human Rights System and the Inter-American Human Rights System as guidelines for action by the Mexican State. The statistical panorama of femicidal violence in Mexico during the period from January 2016 to April 2020, serves as a reference to analyze the normative design of the Alert Mechanism for Gender Violence against Women, in its aspects: aporia of legitimization to active participation of Civil Society Organizations; and, ambivalence of its subsidiary, emergency nature and its objectives. Introduction: The effective protection of the right to a life free of violence of women represents an irreducible of the Mexican State against the evolution of femicidal violence, in whose tenor, it is necessary to consider the provisions of the Inter-American Court of Human Rights that, through its decisions, has established important aspects in addressing this problem. This article focuses its analysis on two areas of the normative design of the Alert Mechanism of Gender Violence against Women in Mexico: ambivalence in its subsidiary, emergency nature and its objectives; and, the limitation to the active participation of Civil Society Organizations in their procedure, points of opportunity that must be addressed to ensure the right to a life free of violence.
