| Resumen en inglés | The relationship between the institution of effective judicial protection and the recovery of assets was analyzed, by virtue of the fact that the first is essential in a Rule of Law that allows having elements to materialize the rights that come together in the framework of a process, between them, the execution of judicial decisions. In this sense, the research was carried out under a qualitative approach, using the dogmatic-legal method, obtaining as conclusions that said institution houses access to the courts, the right to obtain a reasoned decision based on law, as well as the right to execute said decision, the latter being the central aspect of the study, which starts from the idea that the recovery of assets can be achieved with the different procedural mechanisms available through precautionary measures |
| Resumen en español | Se analizó la relación entre la institución de la tutela judicial efectiva y la recuperación de activos, en virtud que, la primera resulta medular en un Estado de Derecho que permite contar con elementos para materializar los derechos que confluyen en el marco de un proceso, entre ellos, la ejecución de las decisiones judiciales. En tal sentido, se realizó la investigación bajo un enfoque cualitativo, utilizándose el método dogmático-jurídico, obteniéndose como conclusiones que dicha institución alberga el acceso a los tribunales, el derecho a obtener una decisión motivada y fundada en derecho, así como el derecho a ejecutar dicha decisión siendo esta última el aspecto central del estudio, que parte de la idea de que la recuperación de activos se puede lograr con los distintos mecanismos procesales disponibles a través de medidas cautelares. |
