| Resumen en inglés | The law in the State and the state in the law. The focus of this work is the role of law in the State according to Hegel. The reflections developed have as reference the text Elements of the Philosophy of Right. The hypothesis is that law, as the result of the formation of the State, dialetictly constitutes itself the forming element of the State. While condition for the law, the State is, at the same time, a result of the moments that precede it – that is, the family and civil society. The formation of the State allows to infer that the law already comes previously to it. However, what law is in the family and in civil society will be overcome in the State |
| Resumen en portugués | O objetivo é o papel da lei no Estado a partir da filosofia de Hegel. As reflexões desenvolvidas têm como referência o texto Princípios da Filosofia do Direito. A hipótese é que a lei enquanto resultado da formação do Estado, dialeticamente, se constitui em elemento formador do próprio Estado. Este, enquanto condição para a lei, é, ao mesmo tempo, resultado dos momentos que o precedem, ou seja, a família e a sociedade civil. Desse modo, no processo de formação do Estado a lei já se apresenta anterior ao Estado. Contudo, o que a lei é na família e na sociedade civil será suprassumido na realidade do Estado |
