Resumen en inglés The present text is an exposition of the Abstract Right of the Hegel’s Legal Philosophy. Its objective is to stand out the direction of having, content of the Abstract Right as estimated for the morality, that is, it to be free. The argument consists of remembering that the freedom doesn’t restrict the individual speeches and interests, but in creating the necessary conditions so that a life is free. In way that the dialético process of the moments of the concretion of the freedom is in fact a way of social relation where the bedding of the right is the personality in general in its relation with the things, that it constitutes the sphere of the legality, but also that this sphere in its concretude is one estimated for the morality. A villain cannot be free, therefore as Hegel the right to have is a universal right and not only of some particular ones. In this manner the Right for Hegel is the idea of the efetivação of the freedom that understands the right to have, the right and right to be free to have and to be free, that it constitutes the citizenship right. However what it justifies this analysis in the present time is accurately the fulfilment of this right not to have, in a morally antagonistic society, whose fabric continues creating the wealth and the misery. But in this paper we only comment the right to have in its explicitation: the personality, the possession, the property, the contract, the injustice and the violence
Resumen en portugués O presente texto é uma exposição do Direito Abstrato da Filosofia do Direito de Hegel. O seu objetivo é ressaltar o sentido do ter, conteúdo do Direito Abstrato, como pressuposto para a moralidade, isto é, para o ser livre. A argumentação consiste em lembrar que a liberdade não se restringe a discursos e interesses individuais, mas em criar as condições necessárias para que uma vida seja livre. Assim, o processo dialético dos momentos da concretização da liberdade será de fato um modo de relação social onde o fundamento do direito será a personalidade em geral, na sua relação com as coisas, esfera da legalidade. Tal esfera será também, na sua concretude, um pressuposto para a moralidade. Um miserável não pode ser livre, pois, segundo Hegel, o direito de ter é um direito universal e não somente de alguns particulares. Desse modo, o Direito para Hegel é a ideia da efetivação da liberdade que compreende o direito de ter, o direito de ser livre e o direito de ter e ser livre, que constitui o direito de cidadania. Entretanto, o que justifica esta análise na atualidade é exatamente o não cumprimento deste direito de ter, numa sociedade moralmente antagônica, cujo tecido continua criando a riqueza e a miséria. Neste artigo comentamos somente o direito de ter nas suas explicitações: a personalidade, a possessão, a propriedade, o contrato, a injustiça e a violência
