| Resumen en español | La importancia de Claudio Antón de Luzuriaga para el derecho español es innegable: ministro de Estado, magistrado y precursor de la codificación civil en España, es señalado expresamente por García Goyena como el autor de los títulos XIX y XX del Libro III, del proyecto de Código Civil español de 1851, referidos a las hipotecas y al registro público inmobiliario, respectivamente. Sin embargo, es más que eso para la fundación del sistema de registro inmobiliario chileno, ya que muchas normas de aquellos dos títulos sirvieron de base para la redacción del Reglamento para la Oficina del Registro Conservatorio de Bienes Raíces chileno que data de 1857, obra que en nuestro país atribuimos al jurista, juez y político José Alejo Valenzuela. | Resumen en inglés | The importance of Claudio Antón de Luzuriaga for Spanish Law is undeniable: Minister of State, magistrate and precursor of civil codification in Spain, is expressly indicated by García Goyena as the author of titles XIX and XX of Book III, of the draft Spanish Civil Code of 1851, referring to mortgages and public real estate registration, respectively. However, it is more than that for the foundation of the Chilean real estate registry system, since many regulations of those two titles served as the basis for the drafting of the Regulation for the Office of the Chilean Real Estate Registry dating from 1857, a work that in our country we attribute the jurist, judge and politician José Alejo Valenzuela. In the present work, we value the extent of the contributions and the way in which those influenced the creation of the system, from a historical and critical perspective |
