| English abstract | This article aims to examine one of the most important issues currently in the country, land use regulation. Evaluates it in historical and social context, considering the aspect of housing, the territorial organization and justice. It highlights the progress of federal legislation culminating in the history and the problematic issue for the city of Goiânia in terms within the Areas of Social Interest - II, which deals with illegal subdivisions. The central purpose of the study is to present the social function of property, instruments that can be used to secure tenure and disorders that brings your company does not exercise. Finally will be evaluated public policies established and functioning in society in order to challenge the best measure to track and present it |
| Portuguese abstract | Este artigo tem por objetivo analisar um dos temas mais importantes atualmente no país, a regularização fundiária. A avaliação concentra-se no âmbito histórico e social, tendo em vista o aspecto da moradia, da organização territorial e da justiça. Destacam-se, ainda, os avanços da legislação federal, o que culmina na problemática do assunto para o município de Goiânia, considerando-se as Áreas de Interesse Social – II, que trata de parcelamentos ilegais. Desse modo, o intuito central do estudo é apresentar a função social da propriedade, os instrumentos que podem ser usados para regularização fundiária e os transtornos que o seu não exercício pode trazer à sociedade. Finalmente, busca-se avaliar as políticas públicas estabelecidas e seu funcionamento perante a sociedade, de forma a questionar a melhor medida a ser implantada |
