| Resumen en español | La adopción de un sistema de protección específico de variedades vegetales en México es fruto de los compromisos del Tratado de Libre Comercio para América del Norte (TLCAN). En punto al régimen jurídico la Ley Federal de Variedades Vegetales de México cumple con el Convenio de la Unión Internacional para la Protección de Obtenciones Vegetales (CUPOV) de 1978, esta contiene una definición de variedad vegetal; y, establece como requisitos para proteger una variedad la novedad, la distintividad, la homogeneidad y la estabilidad. El ámbito de protección es más extenso que el que exige el CUPOV de 1978. Ahora bien, en cuanto a los procedimientos administrativos, y más en lo referente a nulidad, revocación y -sobre todo- infracción; la legislación es endeble |
| Resumen en inglés | Adopting a specific protection system of plant variety in Mexico is the result of the commitment of the North American Free Trade Agreement (NAFTA). According to the Legal regulations the Federal Law Plant Variety in Mexico, obeys the 1978 agreement of the International Union for the Protection of New Variety of Plants UPOVC, which contains a plant variety definition and establishes as requirements to protect a variety; the novelty, the distinctive, the uniformity and the stability. The scope of protection is wider than the one that demands the 1978 UPOVC. Regarding the administrative procedures, and more over, in the subject of invalidity, revocation and even more infraction, the legislation is weak |
