| Spanish abstract | El presente artículo está dirigido al tratamiento que se le ha dado legislativamente al matrimonio igualitario y su interpretación constitucional en México a través del ejercicio de los medios de control constitucional, haciendo énfasis en la acción de inconstitucionalidad 02/2010, interpuesta por el procurador general de la república de su momento. Este estudio está cimentado desde la perspectiva de la relación jurídica, dejando de lado la heterosexualidad de los cónyuges y el objeto reproductivo del mismo, en aras de regularlo a través de normas y principios jurídicos, de acuerdo con las exigencias de la realidad social, sin dejar de lado la dignidad humana |
| English abstract | This article addresses the treatment that has been given to egalitarian marriage legislation and its constitutional interpretation in Mexico through the exercise of constitutional control, emphasizing the action of unconstitutionality 02/2010, filed by the General Attorney of the Republic in office at that time. This study is built from a perspective of legal relationship, leaving aside the heterosexuality of spouses, and the reproductive object of the couple, with the aim of regulation through legal norms and principles, according to needs of social reality, not leaving aside human dignity |
