| Spanish abstract | El fenómeno liberatorio, conocido en el derecho continental como fuerza mayor o imposibilidad sobrevenida, entendido como el supuesto bajo el cual el deudor obligado, frente a un hecho extraño a él, imprevisible e irresistible, se ve liberado; la distinción entre la fuerza mayor y el caso fortuito; las diferencias o semejanzas de los eventos liberatorios en el derecho del common law y el derecho comercial internacional; y en general, el estudio global del concepto de la fuerza mayor en los diferentes sistemas, son los temas desarrollados en el presente artículo. En éste, producto de una investigación concienzuda sobre el tema, encontrara el lector los nuevos efectos del fenómeno liberatorio, que van desde el efecto suspensivo hasta la asimilación de la inexigibilidad con la imposibilidad sobrevenida |
| English abstract | The liberatory phenomenon, known in the continental tradition as force majeure or supervening impossibility, understood as the assumption under which the debtor, faced to a fact , strange to him, unforeseeable and irresistible, is released; the distinction between the force majeure and the cas fortuit; the differences or similarities of the liberatory events in the common law and in the international commercial law; and in general, the global study of the concept of the force majeure in the different law systems, is the subject of the present article. This one, product of a deep research about the subject, would allow the reader to find the new effects of the liberatory phenomenon, such as the suspension effect, and the assimilation of the performance against the good faith with the supervening impossibility, among others |
