| Spanish abstract | La protección de los derechos humanos depende, de manera creciente, de una apropiada interacción entre los sistemas jurídicos nacionales e internacionales. Este artículo interpreta esa dinámica como una “protección multinivel”, y explora las oportunidades y desafíos que la misma presenta para América Latina. El texto hace primero una introducción al concepto de “protección multinivel”, indagando sus orígenes y contextos de creación. Así mismo, investiga las instancias de protección multinivel de los derechos humanos en América Latina, y concluye que las mismas se concentran en el sistema interamericano. ¿Cómo empezar a pensar, entonces, la interacción entre ese sistema y las cortes nacionales de la región? El artículo se concentra en esa pregunta, y presenta dos modelos analíticos para responderla: de una parte, el constitucionalismo interamericano y, de otra, el pluralismo jurídico. | English abstract | Human rights protection depends, increasingly, on an appropriate interaction between domestic and international legal systems. This article interprets this dynamic as a “multi-level protection”, and explores the opportunities and challenges it presents for Latin America. The text first introduces the concept of “multi-level protection”, investigating its origins and context of creation. It also seeks for instances of multilevel protection of human rights in Latin America, and concludes that they are to be found mostly in the Inter-American System. How to start thinking, then, about the inter - action between that system and national courts of the region? The article focuses on this question, and presents two analytical models to answer it: Inter-American Constitutionalism, and legal pluralism. Each of these possibilities involves opportunities and challenges, which are discussed in the conclusion |
