| English abstract | This paper analyzes how the Law was used by the authoritarian regime to promote the National Security Doctrine (NSD) in Brazil. We observe, on the Brazilian case, the formation of an authoritarian legality which produces the legitimation of the acts practiced in name of the dictatorial State. This contributes, after the transition to democracy, to the oblivion of human-rights violations perpetrated during the dictatorship. Today, legal possibilities to deal with the memory of this period are being discussed especially through the concepts of “transitional justice” and “anamnetical justice.” |
| Portuguese abstract | É analisada a forma como o Direito foi apropriado pelo regime autoritário brasileiro a serviço da Doutrina de Segurança Nacional (DSN). Observa-se que é constituída, no Brasil, uma legalidade autoritária que resulta na legitimação dos atos praticados em nome da ditadura e propicia, após o retorno à democracia, o esquecimento dos crimes cometidos. Atualmente, vê-se que são discutidas possibilidades jurídicas de enfrentamento do tema, analisando os conceitos “justiça de transição” e “justiça anamnética”.
