| English abstract | This article analyzes the right to health in the Brazilian State, initially examining its link with the evolution of fundamental rights, mediated by the action of the Judge-State in the Democratic State of Law and its correlation with the principles of separation of power and the reserve of the possible. With the consecration of the right to health, its recognition by the Judiciary power supported by the premise of access to justice, becomes the focus of many discussions and claims. By foreseeing the right we are also securing it, providing the citizen with constitutional instruments and mechanisms to make it effective, with their respective procedural judicial protection. And it is in this context, with necessary recognition of the right to health, that we come across a new way of acting from the Judiciary |
| Portuguese abstract | Este artigo analisa o direito à saúde no Estado brasileiro, inicialmente examinando sua vinculação com relação à evolução dos direitos fundamentais, mediada pela atuação do Estado-juiz no Estado Democrático de Direito e sua correlação com os princípios da separação de poderes e da reserva do possível. Com a consagração do direito à saúde, seu reconhecimento pelo Poder Judiciário amparado no pressuposto do acesso à justiça, torna-se ponto central de inúmeras discussões e reivindicações. Ao prever o direito estamos também o assegurando, munindo o cidadão de instrumentos e mecanismos constitucionais para torná-lo efetivo, com sua respectiva proteção judicial processual. E é neste contexto, de necessário reconhecimento do direito à saúde, que nos deparamos com um novo modo de atuar do Judiciário |
