Spanish abstract Esta investigación tiene por objeto analizar los discursos formulados por las instituciones que dan vida y presencia a la Organización Internacional del Trabajo (OIT), vinculantes con la noción de un nuevo diálogo social y de la inspección del trabajo. Su perspectiva abarca las debilidades históricas del sistema de democracia y participación en la OIT que impiden la cooperación internacional, y la utilidad tanto del diálogo social como de la inspección del trabajo, en el logro de la justicia social y el trabajo decente. Se analiza la interpretación dada por la Corte Permanente de Justicia Internacional con relación a la normativa OIT para seleccionar a las organizaciones sindicales más representativas de trabajadores y empleadores y su influencia en la legislación nacional. Se estudian los criterios de representatividad observando la necesidad de refutarlos y promover transformaciones que arrojen más luz y transparencia. Se examinan los discursos respecto a la inspección del trabajo y sus deficiencias relacionadas con una cultura de incumplimiento de la ley y graves restricciones en determinados sectores. En el estudio se identifica la sinergia entre el diálogo social y la inspección del trabajo y sus debilidades comunes, generando, desde el análisis hermenéutico, una aproximación interpretativa respecto a la participación y democracia en la OIT. Concluimos en que existe, sin lugar a dudas, una interdependencia, complementariedad e importancia para el trabajo decente que tienen ambas instituciones laborales, en contraposición al rezago de una urgente revalorización, con auténtica dimensión social
English abstract The purpose of this research is to analyze the discourses emitted by the most representative institutions within the Labor International Organization (LIO) which are related to the notions of a new social dialogue and of the labor inspection. Its perspective comprises the historical weaknesses of the democracy and participation system in the LIO which constrain international cooperation and the use of both social dialogue and labor inspection in the achievement of social justice and decent work. The interpretation given by the Permanent Court of International Justice in relation to the LIO norms to select the workers and employees’ most representative syndical organizations and its influence on national legislation is analyzed. Representativeness criteria are studied by observing the need to refute them and to promote transformations that produce better results. Discourses regarding labor inspection and its deficiencies in relation to a law braking culture and to severe restrictions in specific sectors are being examined. Through this research, the synergy between social dialogue and labor inspection and its common weaknesses is identified, generating, from the hermeneutic analysis, an interpretative approach with respect to participation and democracy in the LIO. It can be concluded that there exists an interdependency, a complementarity and an importance for decent work that both labor institutions have, in contrast to the delay of an urgent revaluation, with an authentic social dimension
