| Spanish abstract | En éste artículo me propongo, en primer lugar, mostrar que no es posible dar cuenta de la evolución que ha desembocado en lo que llamamos el “Estado constitucional” considerando tan sólo algunos cambios estructurales de nuestros sistemas jurídicopolíticos. Es decir, sostendré que tomando en cuenta únicamente nociones neutrales y/o avalorativas como las de “Constitución rígida” y “Constitución regulativa” no es posible entender el alcance de las transformaciones en curso. Sin el componente de valor que implica la Constitución del “constitucionalismo político” (la Constitución como ideología), el Estado constitucional simplemente no se entiende. Una vez sentado lo anterior, pretendo poner de manifiesto algunas contradicciones internas del constitucionalismo. Estas contradicciones nos permitirán entender el papel que juegan las concepciones constitucionales. A partir de ahí, trataré de mostrar que una buena concepción de la Constitución tiene que ser capaz de integrar y dotar de sentido la presencia de elementos en tensión y para ello tomaré como ilustración la necesidad de integrar tanto el momento de “darse una Constitución” cuanto el de “vivir en Constitución” |
| English abstract | This atricles hopes to firstly show that is it not possible to give account of the evolution that has ended with what is called “Constitutional state”, considering only some of the structural changes of our judicial-political systems. This article supports the idea that it is not possible to understand the scope of the current transformation, considering only neutral and/or avalorative notions such as “Rigid constitution” and “Regulatory constitution”. Without the value component implied by the constitution of “political constitutionalism” (the constitution as an ideology), the Constitutional state is not simply understood. After the latter, the text will manifest some internal contradictions of constitutionalism. These contradictions will help the reader understand the role of the constitutional conceptions. From there on, the text will try to show that a good conception of the constitution has to be able to integrate and give sense to the presence of tensed elements, and therefore showing how there is a need to integrate the “to give a constitution” moment, to “living in constitution” |
